General terms and conditions
Please note: This English translation is intended as a service to English-speaking visitors. For legal validity, only the German version of this document is valid.
I. Scope of application
- These general terms and conditions apply to agreements relating to the temporary rental of hotel rooms at Sauerland Alpin Hotel for lodging purposes, as well as all related additional services provided by the hotel to the customer (hotel overnight stay agreement).
- Subletting or subletting the rooms provided, using hotel rooms for purposes other than lodging, public invitations or promotional activities (such as job interviews, sales demonstrations, or similar gatherings), and using hotel spaces outside the rented rooms require the hotel's prior written consent. An additional fee may be charged. Section 540, paragraph 1, sentence 2 of the German Civil Code (BGB) does not apply, unless the customer is a consumer.
- The customer's general terms and conditions only apply if this has been expressly agreed in writing.
II. Formation of the agreement; limitation period
- The agreement is concluded once Sauerland Alpin Hotel accepts the customer's request. The hotel can confirm the booking in writing.
- The customer is obliged to report, upon concluding the agreement, without express request, if the use of the hotel services may affect the normal operations, safety or reputation of the hotel.
- All claims against Sauerland Alpin Hotel expire within one year from the statutory commencement of the limitation period, with the exception of claims for damages and claims based on gross negligence or wilful misconduct.
III. Services, prices, payment, settlement
- The guest is obligated to pay the agreed-upon prices for the room and other services. This also applies to external services advanced by the hotel.
- Prices include applicable taxes and local levies. Local tourist taxes are not included. Prices will be adjusted in the event of tax changes, unless they apply to consumer contracts executed within four months.
- In case of a request to reduce the number of rooms or length of stay, the hotel may request an adjusted price.
- When paying by invoice, a payment term of 10 days after invoice date applies, unless otherwise agreed.
- For each reminder in case of late payment, an administration fee of €5 will be charged.
- The hotel may request a prepayment or deposit upon conclusion of the agreement. The amount and payment terms will be agreed upon in writing.
- In certain cases (e.g. late payment) the hotel may also request a higher deposit or prepayment after booking.
- The hotel may require a deposit or prepayment upon arrival or during your stay if this has not already been paid.
- Offsetting is only permitted with undisputed or irrevocable claims.
IV. Cancellation by Customer / Non-use of Services
- The guest can cancel the agreement at any time before arrival. In that case, the hotel loses the right to the agreed-upon travel price, but is entitled to a reasonable cancellation fee:
- Cancellation from 14 to 8 days before arrival: 50%
- Cancellation from 7 to 1 day before arrival: 90%
- Cancellation on the day of arrival or no-show: 100%
Exceptions apply in the event of force majeure or extraordinary circumstances that make the stay impossible.
- These compensations are based on the time to arrival, expected savings, and income from replacement bookings. The customer must prove that no or less damage occurred.
- The date of receipt of the cancellation by the hotel is decisive.
- The hotel can also cancel itself in case of force majeure and must report this immediately.
- In case of cancellation by the hotel, the customer is entitled to a full refund within 14 days.
- Cancellations must be communicated on a durable data carrier.
V. Cancellation by the hotel / Prohibited gatherings
- If the customer has an option right, the hotel can terminate this if other customers show interest, unless the customer confirms within the specified period.
- The hotel may also make extraordinary cancellations, including in the case of:
- Force majeur
- Incorrect customer information
- Suspicions of reputational damage or insecurity
- Illegal use or misuse of spaces
- Non-payment despite reminder
- Unapproved events may be stopped.
- In case of justified cancellation there is no right to compensation.
- In case of cancellation, the hotel may claim a lump sum compensation.
VI. Rooms: availability, transfer and departure
- There is no right to a specific room unless agreed in writing.
- Check-in starts at 3:00 PM. If you are not present after 6:00 PM without prior notice, your room can be passed on.
- Check-out is by 10:30 AM. Late departures may incur a charge of up to 50% of the room rate (until 6:00 PM) or 90% (after 6:00 PM).
VII. Liability of Sauerland Alpin Hotel
- The hotel is liable for injury or death due to negligence or intent. For other damages, it is liable only in the event of gross negligence or breach of essential obligations.
- Abandoned property is kept for three months. After that, it is handed over to the local lost and found office or destroyed.
- Use of parking spaces does not entitle you to storage. The hotel is not liable for damage except due to gross negligence.
- Mail and parcels are handled with care and can be forwarded upon request for a fee.
VIII. Final provisions
- Amendments to the agreement must be made in writing. Unilateral changes by the customer are invalid.
- Place of performance and payment is the location of the hotel.
- For disputes, the competent court is located at the location of the hotel, unless mandatory law provides otherwise.
- This agreement is governed by German law. The Vienna Sales Convention is excluded.
- If any provision is invalid, the remaining provisions will remain in full force and effect.
